Iโm getting this question a lot right now because the headlines are misleading: So we can just go hire anyone we want now because of the FTC rule that passed yesterday? Well you could, BUTโฆthe Rule doesnโt take effect for 120 days and is already the subject of lawsuits seeking to prevent it from ever taking effect. The Rule says it doesnโt apply to causes of action accruing before the effective date in 120 days, so anything you do before then may not be protected by the Rule. And most importantly, noncompetes are one piece of the equation. If you hire an employee from a competitor, that competitor will still have legal recourse regardless of the Rule for other contract clauses (non-solicits or non-disclosures), trade secrets, tortious interference, unfair competition, conspiracy, etc. So the Rule yesterday is not a good reason to green light hires today. We have a great team of experts in this space (Eric Packel, Scott Gilbert, Jason Weber, Sean Gallagher, Arindam Kar, to name a few) and we are working feverishly to stay on top of these developments. Hunt Transport Services, Inc., Knight-Swift Transportation, and XPO have placed immense pressure on smaller firms, making it hard for them to stay afloat.
